The federal law regulates issues concerning the responsibility of individuals and legal entities for violating Russian legislation on subsoil resources.
These amendments bring the law On Subsoil Resources into accordance with the Russian Federation Criminal Code, the Administrative Offences Code, and several other federal laws.
Under the federal law persons or entities found guilty of breaching Russian legislation on subsoil resources are subject to criminal and civil liability in accordance with the laws of the Russian Federation whereas such a liability does not relieve the guilty parties from their obligation to eliminate results of detected violations of the law and compensate for damages caused.
The federal law also regulates such compensation. The procedures for calculating the extent of the damage caused shall be set by the Russian Federation Government.
Since the federal law’s implementation requires the adoption of a number of by-laws, its entry into force is set for January 1, 2013.
