Amendments to Labour Code prohibiting certain individuals from holding public office

Vladimir Putin signed the Federal Law On Amending the Labour Code of the Russian Federation.

The Federal Law supplements the Labour Code of the Russian Federation with Article 3496, pursuant to which individuals who do not have citizenship of the Russian Federation and citizens of the Russian Federation who have citizenship (nationality) of a foreign state or who are in possession of a residence permit or another document confirming the right of permanent residence of a citizen of the Russian Federation in a foreign state, shall be prohibited from holding office in state or local authorities, with the exception of state or municipal service duties, and prohibited from holding positions that require state secret security clearances, unless otherwise stipulated by the federal laws and international treaties of the Russian Federation.

The Federal Law comes into effect on July 1, 2021. However transitional provisions are stipulated to allow workers who do not meet the requirements for carrying out the aforementioned duties as of the law’s effective date to inform their employers of such non-compliance and address the situation.
