Law establishing legal regime for the deportation of foreign nationals unlawfully present in the Russian Federation

Vladimir Putin signed the Federal Law On Amendments to Certain Legislative Acts of the Russian Federation.

The federal law is aimed at increasing the effectiveness of federal state control in the field of migration.

To this end, several provisions have been added to the Federal Law On the Legal Status of Foreign Citizens in the Russian Federation introducing a legal framework for deportation, which will be applied to foreign nationals who have no legal grounds for staying in the Russian Federation. The new legislation also introduces the concept of a person under supervision, creates a register of persons under supervision and defines measures of federal state control in the field of migration applied in such cases.

As viewed by the law, deportation entails the restriction of the ability to exercise certain rights by a foreign citizen unlawfully present in the Russian Federation. The law lists the measures to ensure the deportation regime.

The law stipulates that a deportable person, liable to enforced deportation or administrative removal (with the exception of persons ordered to depart independently under supervision if a relevant decision has been made on their case) can be held in custody in specially designated premises of the territorial internal affairs departments for up to 48 hours without a court decision. Holding the deportable person for a longer period will require a court decision.

In order to prevent foreign nationals from pursuing illegal employment in Russia without obtaining the appropriate permits, the Federal Law reduces the period of temporary stay of foreign citizens in the Russian Federation provided for by the Federal Law On the Legal Status of Foreign Citizens in the Russian Federation from 180 to 90 days during the year.

The Federal Law also empowers bailiffs to execute decisions of internal affairs bodies (police) on the removal of foreign citizens from the Russian Federation.

In addition, corresponding amendments are being made to a number of other legislative acts of the Russian Federation.
