Law clarifying liability for violations related to activities of foreign agents

The President signed Federal Law On Amendments to the Code of Administrative Offences of the Russian Federation.

The Federal Law establishes administrative liability for failure to comply with lawful demands issued by an official of an agency authorised to exercise state control over compliance with legislation of the Russian Federation concerning foreign agents, or by its territorial body, or for preventing such an official from performing their duties.

The Federal Law also clarifies provisions of the Russian Federation Code of Administrative Offences, stipulating administrative liability for specific violations of foreign agent activity regulations. These violations include the production and dissemination of materials, including through mass media and the internet, the submission of materials to public authorities, educational institutions, or other bodies or organisations, or dissemination of information – including through mass media and the internet – without indicating that such materials (or information) were produced, disseminated, or submitted by a foreign agent or pertain to the activities of a foreign agent, in cases where such indication is mandatory under the Federal Law On Monitoring the Activities of Individuals Under Foreign Influence.

Furthermore, it is established that a person who commits an administrative offence under Article 19.34 of the Russian Federation Code of Administrative Offences (violation of foreign agent activity regulations) outside the territory of the Russian Federation shall bear administrative liability under the said Code if the offence is directed against the interests of the Russian Federation, or in cases stipulated by an international treaty of the Russian Federation, provided that the person has not been held criminally or administratively liable for the same actions in a foreign state.
