Introducing criminal liability for assisting the enemy in activities deliberately directed against national security

The President signed Federal Law On Amendments to the Criminal Code of the Russian Federation and the Criminal Procedure Code of the Russian Federation.

The Federal Law imposes criminal liability for aiding and abetting the enemy in activities deliberately directed against the security of the Russian Federation, defines the investigative jurisdiction and criminal jurisdiction for this type of crime, and stipulates the confiscation of property obtained through the perpetration of this act.

A footnote to the Criminal Code article on high treason clarifies the notions of “enemy” and “adhering to the enemy,” as well as the possible grounds for exemption from criminal liability for committing certain crimes against the foundations of the constitutional order and state security.

Foreign nationals and stateless persons on Russian territory are subject to criminal liability for cooperation, on confidential terms, with a representative of a foreign state, international or foreign organisation.

In addition, the amendments clarify the conditions on which a person serving life imprisonment will not be eligible for parole, and establish differential criminal liability depending on the type of complicity in a violent unrest or the consequences thereof.
