The provisions of Article 1042 of the Russian Federation Criminal Code make it possible to confiscate money of an amount equivalent to the value of assets subject to confiscation in cases when confiscation of the assets themselves is impossible.
In some cases, however, a convicted person does not have enough monetary funds to meet the required amount, but does possess other liquid assets such as real estate, securities, and precious metals.
The draft law introduces amendments that make it possible to confiscate not only the convicted person’s money but also his other personal property (except for property that cannot be confiscated in accordance with article 446 of the Russian Federation Criminal Procedure Code) to meet the required value in cases where monetary funds are insufficient to cover the amount.
