The Federal Law states expressly that the Russian Federation shall not implement rulings of the European Court of Human Rights that have come into effect after March 15, 2022.
In addition, the Federal Law omits provisions of the Code of Criminal Procedure of the Russian Federation noting that rulings of the European Court of Human Rights are grounds to overturn court verdicts and rulings and to resume the investigation of criminal cases in line with new or newly discovered circumstances.
The Federal Law stipulates the relevant additions to the Code’s Articles 413 and 415 for the purpose of protecting the rights, main freedoms and legitimate interests of citizens and creating an additional compensatory mechanism.
