Administrative liability established for a number of offences in the field of communications and information

The President signed Federal Law On Amendments to the Code of Administrative Offences of the Russian Federation.

The Federal Law introduces administrative liability for a number of administrative offences in the field of communications and information.

In particular, administrative liability is established for violations of legislative requirements governing the submission of information to the state information system that monitors the fulfilment by telecommunications operators of their obligations in the provision of communications services; for failure to comply with statutory obligations incumbent on telecommunications operators, owners or other holders of technological communications networks and traffic exchange points, as well as owners or other holders of communications lines crossing the state border of the Russian Federation; and for violations of legislative requirements in the provision and use of computing capacity for hosting information in an information system permanently connected to the Internet.

The Federal Law also clarifies provisions of the Code of Administrative Offences of the Russian Federation establishing administrative liability for violations of communications legislation in the conclusion of contracts for communications services and in the provision of such services; for violations of requirements concerning the installation of technical means to counter threats to the stability, security and integrity of the functioning of the Internet and public communications networks on the territory of the Russian Federation; as well as for violations of requirements governing the installation of technical means for monitoring compliance by telecommunications operators, owners or other holders of technological communications networks with legislation providing for restrictions on access to information.

In addition, the Federal Law establishes administrative liability for hosting providers for failure to comply with requirements to ensure the stable operation of communications facilities enabling interaction with the communications facilities of other telecommunications operators, owners or other holders of technological communications networks, including those located outside the territory of the Russian Federation.
