In accordance with the terms of the agreement, prisoners will be able to serve their sentence in the country of which they are a citizen, which will help to protect the rights and lawful interests of Russian citizens.
One of the conditions for the transfer of prisoners under the agreement’s provisions is that the prisoner or his representative must give their consent. Following transfer, both the state that handed down the sentence and the state where the sentence is being served are entitled to pardon or amnesty the prisoner.
Some of the agreement’s provisions are at variance with provisions contained in Russian legislation.
The agreement was signed in Moscow on March 23, 2005.
