The President signed the Executive Order to protect the human and civilian rights and freedoms proceeding from the universally recognised principles and norms of international humanitarian law, being guided by Article 80 of the Constitution of the Russian Federation and Article 3 of the Federal Law No. 115-FZ dated July 25, 2002, On the Legal Status of Foreign Citizens in the Russian Federation.
The Executive Order stipulates that that residents of the Donetsk People’s Republic, the Lugansk People’s Republic and Ukraine are entitled to a temporary stay in the Russian Federation without limitations under the Federal Law on condition they pass, following the procedure and deadlines specified by the said Federal Law, mandatory state fingerprint registration, photo identification and a obtain a medical certificate regarding the presence or absence of use of narcotic or psychotropic substances without a doctor’s prescription, or new potentially hazardous psychoactive substances, infectious diseases which endanger others, as well as diseases caused by the human immune deficiency virus (HIV).
Under the Executive Order, such individuals are entitled to work in the Russian Federation without a work permit or a patent regardless of their declared purpose of visit to the Russian Federation after the local body of the Interior Ministry of the Russian Federation checks the identity of the persons and after they obtain a medical certificate.
The Executive Order determines, in particular, the rights and obligations of employers engaging and employing foreign workers who are citizens of the DPR, LPR and Ukraine.
Respective instructions have been issued to the Interior Ministry of the Russian Federation.
The Executive Order also establishes that decisions should not be made with regard to citizens of the DPR, LPR and Ukraine concerning expulsion, deportation, prohibiting entry into the Russian Federation, undesirability of their stay in the Russian Federation and on reducing their stay in the Russian Federation, with the exception of persons released from penitentiaries or those presenting a threat to the national security of the Russian Federation.
The Executive Order comes into effect on the day of signing and is in force until the interim measures set therein are abolished.
